New Pelvic Mesh Trial Ordered in Philly
Updated: Nov 12, 2018
Drug and device maker Johnson & Johnson is facing a new trial in the transvaginal mesh case of Adkins v. J&J, et al. In Adkins, the plaintiff claimed injuries relating to an implant of J&J's TVT-Secur device. The case initially went to trial in 2017 in the Philadelphia Court of Common Pleas, and the jury found the device was defective. However, the jury entered a verdict for J&J, deciding that the defective implant was not the cause of the plaintiff's injuries. On post-trial motions, the trial judge, the Honorable Michael Erdos, ordered a new trial on damages only. Just today, the Judge Erdos amended that order, directing that the case must be retried on all issues, not just damages.
